The Sarit Loyalty Programme Terms & Conditions (T&Cs)

These T&Cs form the basis of the Sarit Loyalty programme. They apply to the relationship between you (being a Member (or prospective Member) of the Sarit Loyalty programme, and terms such as ‘you’ and ‘your(s)’ shall be construed accordingly) and us and are intended to protect both you and us. It is your responsibility to read and understand them before quoting your Membership number to any Programme Partner. They contain very important information about your rights and obligations, as well as limitations and exclusions that may apply. Some of the clauses may be related to other clauses, and therefore we recommend that no clause be read in isolation. Quoting your Sarit Loyalty Programme Membership to any Programme Partner is considered as an acceptance of these T&C. These T&Cs are effective as at the date of their publication and may be changed / modified by us at any time.

  1. Sarit Loyalty Programme

Means the loyalty programme or scheme owned, operated and/or managed by Sarit that rewards its Member with points, rewards and/or any other special discounts, promotions, privileges and/or benefits offered by Participating Entities based on the Members’ purchases of products and/or services.

  1. Membership Agreement

These T&Cs set out the contractual relationship between Sarit and each individual Member of the Sarit Loyalty Programme.

  1. Definitions:

The definitions given here relate to terms mentioned in the Sarit Loyalty Programme, unless the context states or requires otherwise. All defined terms importing the plural shall include the singular and vice versa.

  • ‘Account’ means account containing your personal information, record of accumulated points, points balance, e-purse, rewards, Member discounts, promotions, privileges and/or benefits.
  • ‘Personal data’ means any information which can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, email address, your image, government-issued identification numbers, biometric data, race, and date of birth.
  • ‘Point or points’ means the points awarded to Member for purchases of goods and/or services at Participating Entities Premises under the Sarit Loyalty Programme.
  • ‘e-Purse’ means the amount in Kenya Shillings available in your account that can be used to pay for products or services at participating entities.
  • Earning Activity’ means any transaction made by the Member which enables accrual of Sarit Loyalty in the Member’s Account as defined by Sarit Loyalty from time to time. ‘Qualifying Activity’ is an Accrual Activity which counts towards a member’s account accumulation of points.

General Terms and Conditions

  1. Account and Eligibility
    • To be able to access Sarit Loyalty programme, you will be required to sign up and/or register as a Member through Sarit Loyalty App, Sarit Website or the designated USSD. You will be required to provide Sarit with your personal information, in particular, your name, email address, contact number and/or other details as indicated. The membership is given free of charge and is open to all Kenyans and Non-Kenyans, aged eighteen (18) years and above.
    • Companies based in Kenya – who are enrolled into the Sarit Loyalty App Business Rewards+ programme, membership into which is only open to companies, partnerships, unincorporated associations or similar entities as per the T&Cs of the Business Rewards+ programme.
    • The information or Personal Data that you provide to Sarit shall be processed in accordance with our Privacy Policy. By submitting your Personal Data, you agree to the processing of your Personal Data and you confirm that all information and particulars contained in the application are true and correct. Sarit reserves the right to request you to provide supporting documents to verify your identity.
    • You are responsible for ensuring your Account details including your password remain confidential, current and accurate. You are responsible for all activities that occur under your Account and/or password as if such activities were carried out by you. You shall notify Sarit immediately if you become aware of or have reason for suspecting that the confidentiality of your Account details including your password has been compromised or if there has been any unauthorised use of your Account or if your Personal Data requires updating.
    • Your Account is non-transferable, non-assignable and is for the exclusive use of the Member whose name is shown or registered in Sarit Belong – Loyalty programme.
    • Your Account may be eligible for points, rewards and/or any other special discounts, promotions, privileges and/or benefits offered by Participating Entities based on your purchases of goods and/or services made at Participating Entities Premises upon and subject to these Terms of Use.
    • Sarit has the absolute rights at any time and from time to time without prior notice to decide, determine, classify, designate and/or amend any categories of membership, threshold of membership tiers and/or any promotion or benefit offered in respect of the membership.
    • Further, Sarit reserves the right to suspend or terminate your Account and/or decide on all matters concerning your Account, including the right to decline issuance or renewal of membership or to terminate your Account should you violate the Terms of Use or if it is in Sarit’s best interests to do so, at any time and as and when necessary, without prior notice, including the decisions on points, rewards and/or any other special discounts, promotions, privileges and/or benefits offered by Participating Entities.
    • Sarit reserves the right to enrol individuals / companies with resident addresses only in certain countries and/or regions. Such countries and /or regions are subject to change; however, reasonable advance notice will be given in circumstances where the removal of a country and/or region will affect existing Members from such country and / or region.
    • Membership to Sarit Loyalty is offered at the discretion of Sarit Loyalty and Sarit Loyalty may refuse membership to any Applicant and has the power to cancel the membership of an existing Member without notice in case of violation of any of the T&Cs of the programme by the Member and in such an instance, any unutilized Sarit Loyalty points and Awards that may have been issued will stand revoked.
    • To apply for membership, an individual must complete the Sarit Loyalty enrolment form on the App or on the web portal or at the customer service desk . In case, an individual is in possession of a Sarit Loyalty Account Number, membership can be activated by updating the account documentation i.e. uploading your ID.
    • Membership commences as soon as the Sarit Loyalty Member is in possession of the Account Number. However, Sarit Loyalty points are credited to the account but can be redeemed only once the Member Account is updated with all the documentation in the database after the Programme receives and processes the Member enrolment information.
    • Sarit Loyalty Points can be redeemed only once the Member has completed the verification of both the e-mail address and mobile number registered with the Programme. If either of the two is not verified the Member will not be able to redeem Sarit Loyalty Points.
    • A Member can hold only one Sarit Loyalty Account with a unique and verified e-mail address and mobile number recorded against the same. If there are more than one Accounts containing the same mobile number and e-mail address, then all such accounts will be put under a pending status and Sarit Loyalty points accrual and redemption will be possible only after each account is updated to reflect a verified and unique ID, e-mail address and mobile number.
    • A Member can have supplementary members (closed user group) in his/her Sarit Loyalty Account. Each of the supplementary member will have a unique account number and their verified e-mail address and mobile numbers recorded against the said account. The member who adds the supplementary members (“the main member’) becomes the Admin of the account and has the right to allocate the different access rights to each member under the account. All Supplementary members’ accounts can earn points however they do not have the right to redeem the e-purse unless they are allocated such rights by the Admin. That all points that have been collected by the members in the closed user group shall be automatically converted to e- purse in the closed user group account. Where the admin has issued rights to a Supplementary member to redeem the e-purse, then the Supplementary member will only access the e-purse upon updating their account to reflect a verified and unique ID number, e-mail address and mobile number.
    • The Admin has the discretion to remove a supplementary member from the closed account at any time. When a supplementary member is removed from the closed user group account, the Admin has the discretion to distribute the e-purse accumulated by the Supplementary member who has been removed from the closed user group account or not. The supplementary member who has been removed from the closed user group account can continue earning points as an individual member but will only redeem the e-purse after verifying the individual account.
    • Membership is not transferable.
  1. Fraud

‘Fraud’ includes, but is not limited to, fraud, dishonesty, and deceit and in particular:

  • Knowingly supplying incorrect information, digitally and otherwise, including at the time of booking, to earn Sarit Belong – Loyalty points.
  • Attempting to earn Sarit Belong – Loyalty points from merchants or entities that have not been enrolled for Sarit Belong – Loyalty
  • Altering any Programme Partner documents to procure Sarit Belong – Loyalty
  • Attempting to earn Sarit Belong – Loyalty from partners by any person other than the Member.
  • Unauthorized access of another Member’s account for the purpose of carrying out activities as listed hereunder.
  • Using or attempting to use stolen or counterfeit receipts or invoices on any Programme Partner
  • Attempting to earn Sarit Belong – Loyalty points more than once for the same transaction/ receipt or Programme Partner activity.
  • Knowingly benefiting from the Fraud or misconduct of another Member or individual
  • Selling, bartering and / or purchasing Sarit Belong – Loyalty, Awards. This includes attempting to sell and or / purchase Sarit Belong – Loyalty points and or Awards by means of ineligible Internet-based sales or through any other means
  • Misusing the programme benefits available to certain tiers.

  1. Feedbacks
    • You grant Sarit (and its licensor) a non-exclusive license to use the information that you submit to Sarit Loyalty and/or provide, including but not limited to, questions, reviews, comments, and suggestions (collectively, “Feedbacks”). Sarit shall remove or edit any content that is obscene, indecent, violent, offensive, defamatory, illegal, threatening to public health and safety, infringing Intellectual Property rights, invading privacy or anything that violates the regulations of the Kenyan Communications and Multimedia Content Code. The content must not contain viruses, consist of mass mailings or “spam”.
    • When you post comments or reviews, you also grant Sarit the right to use, copy, display, adapt, transmit, distribute, publish and promote the said Feedbacks in any medium for marketing and promotion purposes or otherwise for any other purpose.
    • You further represent and warrant that the Feedbacks that you sent is owned by you or you control all the rights to the content that you sent or post, that the content is accurate and will not cause injury to any person or entity. You shall not use a false email address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of the Feedbacks.
  1. Force Majeure

Transmissions over the Internet and electronic mail may be subject to interruption, blackout or delays due to internet traffic, or incorrect data transmission due to the public nature of the Internet. Sarit shall not be liable for any non-compliance or delay in compliance with any of the obligations Sarit assumes when caused by events that are beyond Sarit’s reasonable control (“Force Majeure Events”). Force Majeure Events shall include any act, event, failure to exercise, omission or accident that is beyond our reasonable control, including, among others, strike, lockout or other forms of protest; civil unrest, revolt, invasion, war (declared or not); fire, explosion, storm, flood, earthquake, collapse, epidemic, pandemic or any other natural disaster; inability to use public or private telecommunications systems; acts, decrees, legislation, regulations or restrictions of any government or public authority.

  1. Your Use of Sarit Loyalty
    • All contents, materials and information (“Materials”) shown on Sarit Loyalty is intended to be used for personal, educational or informational purposes only.
    • Sarit provides Sarit Loyalty and all other applications, services, features and Materials as a medium to the Members including but not limited to facilitating Members’ shopping need and other special privileges offered by the Participating Entities. To the fullest extent permitted by law, Sarit is not and shall not be liable for any statements, representations or Materials provided on Sarit Loyalty. In particular, Sarit cannot guarantee the accuracy and gives no warranty (either implied or express) in respect of the pricing, discounts, promotions, privileges, availability and quality of goods and/or services purchased from or rendered by the Participating Entities or their suitability for any purpose.
    • You agree not to circumvent, disable or otherwise interfere with security-related features of Sarit Loyalty or features that prevent or restrict use of any content or enforce limitations on use of Sarit Loyalty. You may not interfere with or disrupt Sarit Loyalty or servers or networks connected to Sarit Loyalty, or disobey any requirements, procedures, policies or regulations of networks connected to Sarit Loyalty, including by using any device, software or routine to bypass robot exclusion headers.
    • Sarit is merely the administrator of the Sarit Loyalty Programme. Any dispute concerning the goods and/or services procured from and/or rendered by the Participating Entities shall be resolved between the Member and the Participating Entities involved. Sarit shall not be responsible for any misuse or loss or damage suffered by you in any way on any of the points, rewards, special discounts, promotions, privileges and/or benefits offered by the Participating Entities to you. For the avoidance of doubt, any points, rewards, special discounts, promotions, privileges and/or benefits conferred upon the Member shall be subject to such restrictions, exclusions and terms and conditions as may be prescribed by the Participating Entities and/or Sarit from time to time at its absolute discretion.
  1. Participating Entities’ Contents and Sites

Sarit Loyalty may provide content of the Participating Entities (“Third-Party Content”) as a service to those interested in this information. Sarit does not guarantee, endorse or adopt the accuracy or completeness of any Third-Party Content and shall not be responsible for updating or reviewing the Third-Party Content. You use and rely on the Third-Party Content at your own risk. You acknowledge and agree that Sarit is not responsible or liable for any content, advertising, products or other materials on or available from any Third-Party Content or the availability of any content on the linked sites.

  1. Reservation of Rights

Sarit reserves the right to decide, amend or reserve the points, rewards and/or any other special discounts, promotions, privileges and/or benefits conferred by Participating Entities and you shall be bound by any addition, deletion, variation or amendment made thereof. In the event of any dispute, Sarit’s decision is final and irrevocable.

Sarit reserves the right to modify, discontinue, disable, withdraw, suspend, terminate or cease Sarit Loyalty Programme or any part of Sarit Loyalty at any time, either on a permanent or temporary basis, as Sarit deems necessary, without assigning any reasons thereto. In such a case, Sarit will give prior notice in the manner which Sarit deems appropriate. Upon notification of such withdrawal, suspension, termination or cessation, your Account shall automatically be nullified and invalidated and Sarit shall have no obligation to extend any benefits to the Members.

Sarit further reserve the right, at any time, without notice and in our discretion, to terminate, suspend or restrict your use of Sarit Loyalty and to block or prevent your future access to and use of Sarit Loyalty should you violate any of these Terms of Use.

All provisions of these Terms of Use that expressly survive termination or by their nature are intended to survive termination including disclaimer, limitation of liability and Intellectual Property rights shall survive such termination.

Sarit may access and disclose your Personal Data, including if required to do so by law or in a good faith belief that such access or disclosure is reasonably necessary to:

  1. comply with legal process.
  2. enforce these Terms of Use.
  3. respond to your requests for customer service or otherwise communicate with you; or
  4. verify and process your Personal Data.

Personal Data Protection

By submitting your Personal Data in connection with your Account, you agree that Sarit may contact you including the newsletters, updates or for other administrative purposes and for any other purpose permitted or required by law. Our Privacy Policy provides further detail on the manner in which we may collect and use your Personal Data, including any information you supply in connection with your use of Sarit Loyalty Programme.

The Member consents to Sarit disclosing their personal information to those with whom Sarit has service arrangements and to those with whom Sarit has alliance arrangements. This are the software developer and SMS gateway provider and the information shared is limited to what they require to provide the service.

Specific Terms and Conditions

Normally, a member will earn one loyalty point for every KES 100 spent. However, at certain times the participating outlets may give more points than this, such being bonus loyalty points. The participating outlet reserves the right to exclude any items or services on promotion or sale from the Loyalty Scheme and hence loyalty points may not be awarded for purchases of goods and services that may be on promotion or sale.

A Member can view their balances on points and e-purse on the mobile app or on the customer web portal.

When a member obtains sufficient points, such points may be redeemed at any given time by the Member presenting the member code on the Sarit Loyalty App to any of the participating entities in the scheme.

Redemption value of points is currently at KES 0.70 per point. The redemption will be to the nearest KES 1.00. There is no minimum balance required on your account. Redemption can only be done if the Sarit Loyalty Account has e-purse.

Points have no cash or monetary value and are not redeemable for cash in any form. Points cannot be purchased, resold, for value or otherwise, under any circumstances. Only Sarit Loyalty Members are allowed to redeem their e-purse and they must present their ID. Sarit reserves the right to change redemption criteria.

E-purse can be transferred from one member to another but must be approved by the Sarit Loyalty Programme administrator. Sarit reserves the right to accept or reject the transfer of e-purse.

Unless otherwise stated by Sarit, the Points (e-purse in account) collected and/or earned by Members are valid for twenty-four (24) months from the Points collection date. There shall be no extension of time for the validity period of any unused Points or e-purse. Sarit shall have the right to deal with the expired Points or e-purse in such manner as it deems fit in its absolute discretion. You agree that you will have no claim whatsoever against Sarit for any expired Points/e-purse. E.g., Points collected for purchases made on 30 June 2023 converted to e-purse at the end of June 2023 shall expire on 29 June 2025.

Member may use and/or redeem the Points earned or e-purse at all Participating Entities Premises or at any other outlets or method specified on Sarit Loyalty from time to time. Member may refer to the current list of Participating Entities which is available on Sarit Loyalty App or any other sources as determined by Sarit.

Points/e-purse that Members have successfully redeemed cannot be exchanged and/or cancelled for another reward and/or refundable under any circumstances. No request for exchange will be entertained by Sarit and/or the Participating Entities.

Points shall not be rewarded retrospectively for backdated payment receipts. Points are only awarded for payment receipts/purchases made at Participating Entities on the day of purchase.

Sarit reserves the right to deduct, cancel or suspend a transaction and/or reallocate, recalculate, reverse or adjust Member’s Points or take any necessary action, with or without any notice in the event that Sarit has a reasonable ground to suspect that the Points are rewarded, earned or redeemed fraudulently or in error or related to a transaction which has been cancelled or refund has been effected by Participating Entities to the Members for such cancelled purchase of goods and/or services.

In the event of any refund or cancellation of purchase of goods and/or services, the Participating Entities may withhold and/or cease the Points awarded for such refund or cancellation at it deems fit subject to the Participating Entities’ policy.

The Participating Entities may cancel, suspend, terminate, disallow, reduce, or otherwise change or amend any Points, rewards, special discounts, promotions, privileges and/or benefits conferred upon the Members at their absolute discretion.

Sarit shall not be liable for any delay in recording or posting of the Points earned by Members.

Sarit can, at its discretion, modify the programme rewards or substitute rewards of comparable value without notice.

Sarit reserves the right to discontinue Membership privileges and void a Member’s point balance and rewards if any unauthorized points are earned or redeemed, or if there is any unauthorized use of the programme.

Privacy
The personal information collected during sign up will only be used by Sarit for the sole purpose of providing requested and related services. In joining the Sarit Loyalty Programme, the Member consents to Sarit using their personal information to assist in planning, developing and researching product and service offerings involving Sarit.
This participation (on a purely voluntary basis) may be in advertising campaigns, launches, customer testimonials, product tastings and focus groups; and

How to Cancel Member Loyalty Membership:
The Member may cancel their Sarit Loyalty Membership by emailing instructions or giving instructions in writing. If a Membership is cancelled any Sarit Loyalty Points not already redeemed by the Member will be automatically forfeited. By cancelling the Sarit Loyalty Membership, the Member will stop earning loyalty points from the date of cancellation. Write to value.card@saritcentre.com

SARIT reserves the right, at any time without notice, to:

  1. Decline to accept membership into Sarit Loyalty Programme;
  2. On reasonable grounds, withdraw or cancel Sarit Loyalty membership / Accounts and any points earned there on;
  3. Terminate the Sarit Loyalty Programme:

Reasonable grounds for withdrawal or cancellation include:

  1. Any abuse or attempted abuse of the Sarit Loyalty membership or the Sarit Loyalty Programme;
  2. Any use or attempted use of a Sarit Loyalty Membership in a manner contrary to the Terms and Conditions;
  3. Any use or attempted use of Sarit Loyalty points for purchases made by a person (other than the member or any linked member)
  4. Any reasonable suspicion of dishonesty of a member in connection with the Sarit Loyalty Programme.

Sarit E-Gift Card

  1. You may purchase Sarit E-Gift Card for yourself or a friend on the Sarit Loyalty App or at the Sarit Customer Service Desk at Sarit. For bulk purchase from of E-Gift Cards please contact us via email to value.card@saritcentre.com.
  2. The Sarit E-Gift Card value will be sent to the recipient credited into Members’ Account or received as an sms with a code to their mobile number immediately and they can redeem the amount by shopping at participating entities and partners.
  3. Sarit E-Gift Card is valid for one (1) year unless stated otherwise. The validity is not extendable.
  4. Sarit E-Gift Card is non-refundable, non-transferable and non-exchangeable.
  5. Receivers of the Sarit E-Gift Card shall be fully responsible in ensuring the details provided upon redemption of the Sarit E-Gift Card.
  6. Sarit reserves the rights to alter, amend, delete, add or vary the terms and conditions or withdraw this feature at any time without prior notice.

Changes to Terms and Conditions and Termination:
Sarit reserves the right to change, suspend or terminate these Terms and Conditions, the Sarit Loyalty Programme, and any benefits under the Sarit Loyalty Programme at any time.
Sarit will give advance notice of any such circumstance on its Website or the Member can obtain such details by calling the Sarit Customer Service desk on 0708 702 644, allowing the Member to cancel their Sarit Loyalty membership within the period of that advance notice. Where Sarit changes these Terms and Conditions, an updated copy of them will be available on Sarit’s Website and on the Sarit Loyalty App. Continuing to use the Sarit Loyalty membership after the period of advance notice has expired will be deemed acceptance of the amended Terms and Conditions.

Sarit E-Gift Card Terms and Conditions
